Lex Counsel’s main goal is to assist clients in avoiding litigation wherever possible by devising creative settlement approaches.  For such purposes, we deeply focus in analyzing the opponents’ negotiation weaknesses. Our dispute resolution attorneys settle disputes for clients in the most appropriate manner and in their best interest.

Practice Highlights

  • Successful defense of an investor group in an arbitration procedure at ICSID in Washington D.C. due to an expropriation by the Government of Costa Rica of 75,000 acres of land with 30 miles beachfront for a national park.
  • Obtaining the approval and enforcing by the Controller General and the Government of Costa Rica’s corresponding agency, of a multimillion-dollar contract for migration of software used by the Costa Rican Power and Telecommunication Company (ICE) and then legal actions to obtain payment, when the contracts were suspended and then rescinded by ICE.
  • Defending a major U.S. company in a claim by a local company, successfully settling the case at less than ten percent of the amount of the original claim.
  • Recuperation of a non-secured investment by a U.S. senior citizen in an airline.
  • Obtaining payment provided by an insurance policy, refused by a major insurance company after the accidental death of the insured party.
  • Defending a regional manufacturing corporation of a claim for breach of contract in an ICC international commercial arbitration proceeding in Chile and obtaining a favorable settlement.
  • Representing a Chilean company against the Supreme Court and Judicial Branch of Costa Rica over a breach of contract in an ad hoc international arbitration proceeding based in Washington, DC, followed under UNCITRAL arbitration rules, and obtaining a favorable result.
  • Representing a group of Canadian creditors in a high profiled international-multimillion-bankruptcy case, enforcing the Canadian judgment in Costa Rican courts and recovering assets for the group.
  • Representing domestic partners in a South Carolina’s LLP Company in an international mismanagement case, co-counseled with US attorneys in Federal Courts, and obtaining a favorable result.
  • Representing a foreign venture capital company’s interest in a collection case, which involved arbitration in California, under ICDR rules and arbitration in Costa Rica.
  • Representing a Chilean company in a dumping case investigation conducted by the Government of Costa Rica.
  • Defending U.S. manufacturing companies in claims filed by domestic companies seeking compensation under distribution and agency laws.
  • Counseling and representing foreign investors in a breach of a land sale contract case, and obtaining a settlement to the benefit of clients.
  • Representing and defending Costa Rican amusement park in multiple personal injury cases.
  • Representing a Spanish consortium in multiple personal injury cases, claims against the Government, among others.
